Education Compliance Obligations under the ADA 

Educational entities (both public and private) are covered by the ADA. This includes: early childhood programs K-12 education colleges and universities community colleges vocational/technical programs apprenticeships.

These entities have an obligation to make all services, programs and activities offered to students non-discriminatory and free from barriers to access/participation.  This also includes:

Parents with disabilities access to participation and involvement in their children's education.

Programs or functions that are open to the general public such as musical or athletic events.

Who is Covered:

Students who have a disability as defined by the ADA: an impairment or condition that substantially affects major life functioning.

Note: The definition of a disability under the ADA is different than the definition under the Individual with Disabilities Education Act (IDEA). Students do not have to have an IEP or 504 plan to be considered covered under the ADA.
